Rep. Mikie Sherrill (D-11th) joined fellow Democratic congressman Jamie Raskin of Maryland on Wednesday to continue the conversation about ethics and the U.S. Supreme Court.
Both are calling for associate justices Samuel Alito and Clarence Thomas to recuse themselves from the two cases involving former President Donald Trump and the Jan. 6 insurrection that will be before the U.S. Supreme Court soon. Those calls escalated after news reports that Thomas accepted gifts and vacations from a Republicans donor without disclosing them. And they grew after reports that an upside down flag flew outside Alito’s home in Washington, D.C. and another flag associated with the insurrectionists and Christian nationalists flew outside his New Jersey vacation home.
“Obviously the Supreme Court has not done well at policing itself when we see someone like Justice Thomas for example receiving money from a large Republican donor,” Sherrill at a roundtable on court ethics in Madison.
“Why couldn’t the other seven justices issue a writ of mandamus to Justices Alito and Thomas, to do the right thing and recuse themselves from these cases,” added Raskin.
Alito issued a statement to lawmakers Wednesday saying that he will not recuse himself because the incidents with the flags “…do not meet the conditions for recusal.” Alito putting all the blame on his wife, saying “My wife is fond of flying flags… my wife was solely responsible for having flagpoles put up at our residence and vacation home and has flown a wide variety of flags over the years.”
Sherrill has cosponsored the Supreme Court Ethics Act, which would create a code of conduct for all federal judges and include the U.S. Supreme Court which does not have such a code.
“I think we need an investigative body to investigate some of the charges and weigh in on them,” said Sherrill. “It’s not enough that in their own minds they feel they’re being impartial, they need to exhibit that in every aspect of their life.”
