The family of late NHL hockey star and New Jersey native Johnny Gaudreau and his brother Matthew have sought to block the public release of records and footage of the fatal bicycle crash in late August.

The brothers were struck and killed by an alleged drunk driver while they were riding their bikes on a rural road in South Jersey. Johnny Gaudreau had two children, and both brothers’ wives are currently pregnant.

Nearly a month after their deaths, the family is urging the courts to prevent videos and police records of their deaths from being made public.

According to NJ Advance Media, attorneys representing the brothers’ estates filed a court motion to block all public release of that information. This information includes 911 calls, crash-related records, police dash and body-camera footage, autopsy reports and photos along with any details on the investigation. Law enforcement is barred from releasing any of the records before a hearing on the court order which is scheduled for Oct. 8.

The driver, Sean Higgins, struck the two near Gaudreau’s family home in Salem County. The 43-year-old now has been charged with two counts of second-degree vehicular homicide in the crash. Police documents revealed, that at the time of the collision, Higgins told police he had five to six beers earlier in the day.
