Court to hear challenge to NJ gun law again

Third Circuit Court of Appeals upheld NJ's ban, but plaintiffs quickly challenged that ruling

Gun rights advocates in New Jersey are headed back to federal court to fight a state law that bans concealed-carry of guns in a range of “sensitive places,” including parks, beaches, bars, casinos and more.

The ban was first signed into law by Gov. Phil Murphy in 2022, but challenged in court. Gun owners and advocates argued that the expansive list of restricted places violated their Second Amendment rights to carry a weapon.

A three-judge panel in the Third Circuit Court of Appeals largely ruled against them in September, upholding New Jersey’s ban. But the plaintiffs quickly challenged that ruling, and asked that the full Third Circuit panel of judges re-hear the case. The full panel is made up of 14 active judges, many appointed by President Trump, and it approved a re-hearing, now scheduled for Feb. 11.
