Her time running out in an interim role, Alina Habba may be seeing her last days as U.S. Attorney for New Jersey. The interim status technically ends on Tuesday, which marks 120 days since she was appointed by President Trump and the legal maximum that one in an interim position can serve.

President Trump this month nominated Habba to the permanent role, but she never won a confirmation hearing or vote from the U.S. Senate. And according to statute, that leaves it with New Jersey’s U.S. District Court judges to vote in a new U.S. Attorney, with Habba’s chances looking slim.

According to the New Jersey Globe, Habba has indicated that she doesn’t have the support of the judges when they vote on Monday. The report said that the federal judges are expected to choose instead between two Republican-registered contenders, former U.S. District Court Judge Noel Lawrence Hillman and First Assistant U.S. Attorney Desiree Grace.
